Ordering Goods

The Nature of Goods

Weights, sizes, measurements, and colours may vary slightly. Hand-finished or embroidered garments may have small irregularities, which are not faults.
Made-to-Measure and Altered Garments

Contact us for specification changes before dispatch. Additional fees may apply.
Returns and exchanges

Faulty Goods: Notify us within 48 hours of delivery. We will repair, replace, or refund faulty goods.

Return Process: Contact orders@houseofbanaras.in for return instructions. You are responsible for return shipping costs.
End of Contract

Ending the contract does not affect our right to receive any owed money.
Liability

We are not responsible for unforeseeable losses or those not caused by our breach.

Our total liability is limited to the amount paid for goods and delivery.
Disputes

Indian law governs this contract. The courts of India have exclusive jurisdiction.
Content and Intellectual Property

Sale and Purchase of Goods

House of Banaras’ parent company ("Seller") hereby agrees to sell, and you ("Buyer") hereby agree to purchase, goods of the description and quantity described on the checkout window ("Checkout") and incorporated herein by this reference ("Goods") on the terms and conditions outlined in this Agreement.
Purchase Price

Buyer agrees to pay the purchase price of the goods as posted on the website attached hereto.
Payment Terms

The total amount of the purchase price shall be payable in full by the buyer according to the payment due date stated at checkout. In addition, the seller shall have the right to pursue any remedies available at law or as provided herein and shall be entitled to reimbursement from the buyer for the seller's costs of collection, including attorney fees, legal fees, and costs and disbursements, if any.
Delivery

Unless otherwise agreed in writing, delivery shall be made by the seller's shipping policy in effect on the date of shipment. Delivery dates provided by the seller are estimates only. The seller will make reasonable efforts to deliver by such dates; however, the seller will not be liable for failure to deliver as estimated. Unless otherwise agreed in writing by the seller, goods shall be packaged according to the seller's standards and practices.
Customs, Duties, and Taxes

The recipient is responsible for assuring that the product can be lawfully imported to the destination country. When ordering from houseofbanaras.com, the recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders that are shipped to countries outside of India may be subject to import taxes, customs duties, and fees levied by the destination country. All our shipments are currently sent with delivery duty paid. This means that you do not need to pay any duty or taxes at the time of receiving your shipment. In the exceptional circumstance that duty or taxes are levied on your parcel, please get in touch, and we will help you resolve the matter. Customs policies vary widely from country to country; the recipient should contact their local customs office in case of any formalities required. When customs clearance procedures are required, it can sometimes cause delays beyond our original delivery estimates. The recipient must provide a social security number, tax identification number, or any other form of address or business proof that their customs office requires to have the shipment cleared.
Disclaimer of Warranty/Limitation of Liability

seller undertakes no responsibility for the quality of the goods or that the goods will be fit for any particular purpose for which Buyer may be buying them, except as otherwise provided in this agreement, and the seller disclaims all other warranties and conditions, express or implied.
Colour Disclaimer

The colours of products you see on the computer screen will vary slightly from those of the actual product. This is because of the difference in underlying technologies of computer monitors and fabrics; monitors that are not properly calibrated also add to the difference in colours. In addition, the lighting used while taking photographs also factors into the final colour shown on the screen.
Price Disclaimer

While houseofbanaras.com makes every effort to ensure that the products are described and priced accurately, if an item is deemed to be priced incorrectly, houseofbanaras.com reserves the right to refuse the sale of that item.
Force Majeure

If the seller does not deliver all or part of the goods on time, it is not their fault if it is because of a federal, provincial, or municipal action, law, ordinance, or regulation; a strike or other labour problem; a fire or other damage to or destruction of the goods or the manufacturing facility for the goods; or if the seller cannot get enough raw materials, labour, fuel, electricity, water, or supplies; or if there is some other event that seller cannot reasonably control that delays or stops the production or delivery of the goods. Seller shall determine in good faith the extent to which it can reasonably control a cause, contingency, or circumstance that affects the performance of its obligations.
General

The buyer may not assign this agreement without the seller's written consent. The seller is the sole intended beneficiary of this agreement. If there is any inconsistency between this agreement and any other agreement included with or relating to the goods, this agreement shall govern. This Agreement may not be modified, altered, or amended without the written agreement of Seller. Any additional or modified terms included with any order that the buyer submits are void unless the seller expressly agrees to them in writing. If any term of this Agreement is illegal or unenforceable, the legality and enforceability of the remaining provisions shall not be affected or impaired. This agreement will be interpreted according to the laws of Delhi, India, without taking into account rules about conflicts of law. If there is a dispute about this agreement, the buyer agrees that Delhi is the only place where it can be heard and waives any objections to that.
Third-Party Rights:

Only parties to this contract have the right to enforce its terms.
Right to Amend Terms:

We reserve the right to change terms and encourage periodic reviews.
